1. Acceptance of Terms

By accessing our website or engaging our services, you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our website or services. These terms apply to all visitors, clients, and users of ABC Marketing's website and services.

2. Services

ABC Marketing provides software development, digital marketing, mobile app development, web development, SEO, and social media marketing services. The scope, deliverables, timeline, and pricing of each project will be defined in a separate Service Agreement or proposal signed by both parties.

3. Client Responsibilities

  • Provide accurate and complete information required for the project.
  • Review and provide feedback on deliverables in a timely manner.
  • Ensure all content, images, and materials provided are legally owned or licensed.
  • Make payments as per the agreed schedule.

4. Payment Terms

  • An advance payment (as defined in the proposal) is required before project commencement.
  • Remaining payments are due as per the milestone schedule outlined in the agreement.
  • Late payments may attract a penalty of 2% per month on the outstanding amount.
  • All prices are in Indian Rupees (INR) unless otherwise specified.
  • Applicable taxes (GST) will be charged separately.

5. Intellectual Property

  • All intellectual property rights of the final deliverables will be transferred to the client upon full payment.
  • ABC Marketing retains the right to use the project in its portfolio unless otherwise agreed in writing.
  • Third-party tools, libraries, or assets used in the project remain under their respective licenses.

6. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of the engagement. This obligation survives the termination of the service agreement.

7. Project Timeline & Delays

We make every effort to deliver projects on time. However, delays caused by the client (late feedback, content, or approvals) may extend the project timeline. ABC Marketing will not be held liable for delays resulting from client-side issues or force majeure events.

8. Limitation of Liability

ABC Marketing shall not be liable for any indirect, incidental, special, or consequential damages arising out of the use of our services. Our total liability shall not exceed the amount paid by the client for the specific service in question.

9. Termination

Either party may terminate the service agreement with 15 days written notice. In case of termination, the client will be billed for all work completed up to the termination date. Any advance payment for uncompleted work may be refunded as per our Refund Policy.

10. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Sarana, Bihar, India.
